Terms of Service

General

These Terms of Service (”Terms”) govern purchases you make on and your use of the Spooky Stickers website, spookystickers.site, available by desktop or mobile web, (the ”Site”) controlled by [Le Spirit Designs DBA] (”we”, ”us” or ”Spooky Stickers”).

We reserve the right to update or modify these Terms at any time without prior notice. For this reason, we encourage you to review the Terms before you make any purchase or whenever you otherwise use or access the Site. The date of the latest update is found in the final section of the Terms. If you do not agree to these Terms, please do not make any purchase or otherwise use or access the Site. Your purchase or use of the Site constitutes your agreement to follow and be bound by these Terms.

By accepting these Terms through your purchase or use of the Site, you certify that you are 18 years of age or older. If you are under the age of 18 but at least 13 years of age, you may use the Site or make a purchase only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

We do our best to ensure that information on the Site is complete, accurate and current. Despite our efforts, however, information on the Site may occasionally be inaccurate, incomplete or out of date. All products, descriptions and prices of products on the Site are subject to change at any time without notice, though we will do our best to inform our customers of any changes.

Order Acceptance

After submitting your order, we will send you an order confirmation e-mail with your order number, details of the product you have ordered from us, your payment details and delivery details. We reserve the right to cancel the order throughout the whole manufacturing process if it should prove to be contrary to our Terms of Service. Full refund will be given if an order is cancelled.

Orders will be accepted in the order they are received, though Rush Orders will jump to the top of the line.

Once your order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order. We recommend that you save the confirmations to facilitate any future contact with our customer service.

Payment

Payment is due at time of purchase. Orders not paid in full will not begin processing until payment is made.

The following payment types are accepted:

• Credit and Debit Cards
  • Payment can be made by the following credit cards: Visa, Mastercard, American Express, Discover, Diner's Club International,  JCB, or UnionPay. Please note that your card is debited with the purchase amount once Spooky Stickers has sent you the order confirmation email. All credit/debit card transactions on the Site are processed using Square, a secure online payment gateway that encrypts your card details in a secure host environment. Payment will be debited and cleared from your account upon acceptance of your order by Spooky Stickers. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Spooky Stickers, your order will be cancelled. We are not responsible for any charges or penalties which may be imposed by the payment provider as result of payment being processed in respect of your order.

  • When selecting the PayPal option, you will be directed to the PayPal site to ”Log In” and review the amount shown before clicking ”Pay Now”. Once this transaction is complete, you will then return to the Site.

Delivery Conditions

We offer different shipping methods to meet your needs as further specified when you check out.

We reserve the right to charge a cost of $20 for uncollected packages that are returned from the shipping company to us, as well as packages that are returned due to incomplete or incorrect address from the customer as cover for shipping and handling costs.

Dispatch of orders may take up to 14 business days but we aim to dispatch all orders within 5-7 business days during weekdays. Please note that delivery times are provided as guidelines only, and commence from the date of dispatch. The delivery times do not take into account possible delays caused by payment authorization and/or stock availability. If you need your purchase urgently, please contact us before placing your order so that we will have the opportunity to investigate whether we can deliver according to your wishes.

[Delays can also be caused by the artwork uploaded being in low resolution or otherwise unsuitable to print. We aim to handle communication efficiently to minimize such delays, but in these cases we are often dependent on new files being sent for production to commence.]

Defective Products

If you receive defective products, please notify us immediately by e-mail to [info@spookystickers.site] and within a reasonable time after you have detected that the products are defective. Please note that we will not be able to handle returned products without your prior contact with our customer service. The product must be in the same condition as when you received it to enable us to approve a complaint. If Spooky Stickers reasonably determines that the products are in fact defective, Spooky Stickers will compensate you with a non-defective similar replacement item. Liability

Spooky Stickers’ liabilities to you are limited in each separate case to these Terms unless otherwise is stipulated by law. Spooky Stickers’ liabilities to you for any cause whatsoever will never exceed your total purchase amount for the order.

In no case whatsoever will Spooky Stickers assume any liability for any incidental, consequential or indirect damages such as loss of profit or in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters, epidemics, pandemics or similar events.

Customer Registration

In order for us to fulfill your order we need to register, manage and store the personal information you provide to us.

Our processing of your personal data is collected and stored in accordance with applicable privacy laws, read more in our Privacy Policy.

Inappropriate Content

We reserve the right to remove images or text that is illegal, offensive, obscene, racist or religiously offensive. We also reserve the right to refuse to print designs that we deem offensive.

Copyright

By placing an order, you as a customer certify that you hold all rights regarding the use, publication and transmission of such data that has been transmitted, especially with regard to text and image material.

The Customer is solely responsible for ensuring that the product does not infringe anyone else's intellectual property rights and that the content of the product does not otherwise violate applicable legislation.

The Customer agrees to without prejudice not hold Spooky Stickers responsible for any claims that any third party may address to Spooky Stickers in connection with infringement of third party rights, especially copyright, arising from the use of data transmitted from the customer, which means that the customer will ensure that Spooky Stickers does not have to comply such requirements.

The Customer agrees to indemnify and hold us, our directors, officers, employees, agents, affiliates and subsidiaries harmless from and against any and all claims, damages, costs and expense, including attorney fees, arising from or related to infringement of third party rights, especially copyright, arising from the use of data transmitted from the customer, including text and image material.

Content Permission & Restrictions

Unless otherwise noted, the design of the Site, including the software, source code, text, images and all other content and materials that are part of the Site (collectively, ”Content”) are copyrights, trademarks or other intellectual properties owned, controlled or licensed by us. The Content is intended solely for your personal and non-commercial use. No right, title or interest in any Content is granted or transferred to you as a result of your use of the Site.

Except as noted herein, you may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, any of the Content or the Site. Your misuse of the Content is strictly prohibited and may subject you to liability under applicable laws.

Termination of Account

By ordering and using the Site, you agree that Spooky Stickers may, at its sole discretion, terminate your account and remove and discard any content that you may have contributed to the Site without prior notice.

Registration, Accounts and Passwords

You are responsible for the personal protection and security of any password or username that you may use to access the Site. You are responsible for all activity conducted on the Site that can be linked or traced back to your username or password. You are obligated to immediately report a lost or stolen password or username to [info@spookystickers.site].

If you believe someone has used your password or account without your authorization, you should notify [info@spookystickers.site] immediately. We reserve the right to access and disclose any information including, without limitation, usernames of accounts and other information to comply with applicable laws and lawful government requests.

Governing Law and Disputes

These Terms shall be governed by, construed and enforced in accordance with the laws of United States of America, without giving effect to any principles of conflicts of law. In case any dispute arises in connection with these Terms, the dispute shall be subject to the courts having jurisdiction over Spooky Stickers’ place of business, except in the case of a legal provision of mandatory law which stipulates otherwise.

Provisions Severability

If any part of these Terms is held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms; instead the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these Terms.
